Page 3 of 6 <br />April 18, 2011 <br />resulting from operation of the Bestway Concrete Well No. 1 (permit no. 67418-F), in <br />accordance with the augmentation plan decreed in Division 1 Water Court case no. 2004CW224 <br />(see Table 4). Since the City of Aurora effluent is being used as a replacement source for both <br />SWSPs and the decreed augmentation plan, the applicant's accounting for each SWSP must <br />specify the total amount of effluent released and the amount associated with each SWSP and <br />the decreed plan for augmentation. <br />The nontributary Laramie-Fox Hills aquifer water will be withdrawn by an existing well <br />pursuant to permit no. 64750-F. The <br />Applicant's accounting includes the 2% relinquishment requirement for the nontributary <br />Laramie-Fox Hills water. <br />In addition to replacing depletions resulting from this mining operation, the Laramie-Fox <br />Hills aquifer water will also be used by the Applicant to replace 10.84 acre-feet of depletions <br />resulting from operations at the Parker-Dersham Resource site in accordance with the C.R.S. <br />37-92-308(11) SWSP approved for Hall-Irwin (see Table 4). Since the Laramie-Fox Hills water <br />is being used as a replacement source for both plans, the applicant's accounting for each <br />SWSP must specify the total amount of Laramie-Fox Hills water released and the amount <br />associated with each SWSP. <br />A monthly breakdown of depletions and replacements is shown in the attached Table 3. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of January 1, 2011 through December 31, 2011, <br />unless otherwise revoked, modified, or superceded by decree. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal <br />request must be submitted to this office with the statutory fee (currently $257) by <br />November 15, 2011. <br />2. Well permit no. 66959-F (WDID 0203017) was obtained for the current use and exposed <br />pond surface area of the gravel pit pond in accordance with §37-90-137(2) and (11), <br />C.R.S.
