Varra, (303)-666-6657 - <br />Section 31, Twp 3 North, Rng 67 West, 6th P.M., Weld County <br />CONDITIONS FOR APPROVAL <br />® The purpose of this amendment is to update the reclamation plan for Agricultural and <br />Developed Water Resources for all allowable uses. <br />® According to our records Varra Companies, Inc. obtained a storage water rights decree in case <br />no. 2001 CW274 for the Dakolios Reservoirs. The Dakolios Reservoirs consist of two ponds <br />within the Dakolios Pit permitted area, which were lined with a slurry wall and the lining was <br />approved by the Division 1 Office in accordance with the State Engineer Guidelines for Lining <br />Criteria. <br />However, .according to the Division of Reclamation Mining and Safety amended application <br />approximately 5 acres of ground water remain exposed at the site,' which are proposed to be <br />backfilled. Note, that until the five acres are completely backfilled, the proposed operation will <br />still consume ground water by evaporation. The applicant will need to obtain a gravel pit well <br />permit. However, prior to obtaining a permit, an approved substitute water supply plan <br />("SWSP") or decreed plan for augmentation is required. <br />® Prior to approving a well permit, the applicant must conduct a field inspection of the site and <br />document the locations of all wells within 600 feet of the permit area. The applicant must then <br />obtain a waiver of objection from all well owners with wells within 600 feet of the permit area or <br />request a hearing before the State Engineer. <br />® The Applicant Engineer indicated that the SWSP approved for the Durham Sand and Gravel Pit <br />(M1978-056) will be amended to include the additional depletions from the Dakolios Pit. <br />COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in <br />priority, it must be released to the stream system within 72 hours. This may require a discharge permit <br />from CDPHE-WQCD.
