for the spillway design. Please include a description of the proposed method <br />for protecting the spillway(s) from erosion. <br />12. Pursuant to Rule 4.05.9(9), "...embankments and the surrounding areas shall be <br />vegetated or stabilized by other means to protect against erosion...". Please <br />include a description of the seeding activities planned for the dewatering <br />ponds and the Last Chance Pond and please provide an anticipated seed mix <br />for the pond embankments. <br />13. Pursuant to Rule 4.05.9(14), "...impoundments shall be inspected by a qualified <br />registered professional engineer or other qualified professional specialist under <br />the direction of a professional engineer... regularly during construction, upon <br />completion of construction, and at least yearly until removal...". Please include a <br />description of the inspection process during construction. Please include a <br />commitment to perform the required sediment pond inspections. Please note <br />that an as-built certification for the dewatering ponds and the Last Chance <br />Pond will be required following the completion of construction. <br />Rule 4.06 - Topsoil <br />14. Map 157 shows the location of the topsoil and subsoil stockpile locations for the <br />B-Seam dewatering system ponds. These topsoil and subsoil stockpiles are <br />shown on the outslopes of the ponds. The location of these piles should not be <br />within the dewatering system itself. Please relocate the topsoil and subsoil <br />stockpiles outside of the dewatering system. Please resubmit two copies of <br />Map 157 for review. <br />Rule 4.15 - Revegetation <br />15. BME states that they are going to create an "artificial wetlands" within the B- <br />Seam dewatering system. This artificial wetlands will be partially created by the <br />mine water that is being pumped and discharged to the surface. The other <br />component necessary for wetlands are the wetlands plant species. BME has not <br />provided any information regarding what species will be planted in the artificial <br />wetlands. Please provide a species list for the wetlands plants that will be <br />included for use in the artificial wetlands in the B-Seam dewatering system. <br />Miscellaneous <br />16. BME is creating an artificial wetlands with the construction of the B-Seam <br />dewatering system. Please describe the artificial wetlands and its reclamation <br />following the removal of the B-Seam dewatering system. <br />17. The Division has received comment letters Colorado Historic Society, the <br />Colorado Division of Water Resources and the Colorado Division of Wildlife
