Adapted from EVAPOTRANSPIRATION AND AGRONOMIC RESPONSES IN FORMERLY IRRIGATED <br />MOUNTAIN MEADOWS, South Park, Colorado, March 1, 1990; Revised September 1, 1991 <br />11. This SWSP may be revoked or modified at any time should it be determined that injury to other <br />vested water rights has or will occur as a result of this SWSP. Should this SWSP expire without <br />renewal or be revoked prior to adjudication of a permanent plan for augmentation, all use of <br />ground water must cease immediately. <br />12. If reclamation of the mines at the gravel pit sites included in this SWSP produce a permanent <br />water surface exposing groundwater to evaporation, an application for a plan for augmentation <br />must be filed with the Division 4 Water Court at least three years prior to the completion of <br />mining to include, but not be limited to, long-term evaporation losses. If a lined pond results <br />after reclamation, replacement of lagged depletions shall continue until there is no longer an <br />effect on stream flow. <br />13. Dewatering at the Seahorse Ranch West Pit and Vader Pit will produce delayed depletions to <br />the stream system. As long as the pits are continuously dewatered, the water returned to the <br />stream system should be adequate to offset the depletions. However, once dewatering at the <br />sites cease, the delayed depletions must be addressed. You indicated that the mine sites will <br />remain dewatered while the product is mined and then the mines sites will be allowed to fill with <br />water. Refilling of the dewatered mine sites is only proposed to occur at times there are no <br />active calls on the river placed by a senior downstream water user. According to the historical <br />call record there is no anticipation of a downstream call during the refilling period. <br />14. To assure that depletions from ground water evaporation do not occur in the <br />unforeseen event, or events, that would lead to the abandonment of the pit, the <br />Applicant shall provide an affidavit that dedicates the historical consumptive use credits <br />associated with the dry-up of a portion of the lands previously irrigated by Griffing No. 2 <br />and McCanne Nos. 2 and 3 Ditches. This replacement water shall be provided solely for <br />.this SWSP for as long as there are depletions at these gravel pit sites or until such time <br />as another replacement source is obtained. This affidavit shall be provided to DWR as <br />soon as United and Varra finalize the transfer of the water rights from Varra to United. <br />This SWSP shall not be operational until such time as the affidavit for the dedication of <br />the water rights is provided to the state engineer.
