Response to Preliminary County Comments Received on March 17, 2011 <br />conditions have been approved by the Division through a permit modification, <br />include the following: <br />• Mill retrofit and commissioning; <br />• Ore stockpile consolidation; <br />• Construction of the augmentation pond; <br />• Milling optimization (Phase 2); <br />• Production at May Day 1 level (Phase 3); <br />• Exploration (Phase 4); <br />• Production expansion (Phase 5); and <br />• Milling completion and closure (Phase 6). <br />Response #14(b) <br />Corrective actions have been addressed in the attached revised Exhibit D (Mine Plan) <br />(Attachment E-1) and Exhibit 6.5 (Attachment E-4 through E-8) The outlined activities <br />that have been determined to pose significant potential to affect surface and ground water <br />quality have been mitigated by the commitments made by Wildcat Mining in response to <br />DRMS adequacy issues. <br />(c) The Joint Stipulation was written prior to the current version of the Rules and the <br />reference to Rules 6.4.20(9) and (11) now correspond to Rules 6.4.21(9) and <br />6.4.21(11). <br />Please revise Exhibit D, Mining Plan, to acknowledge the permit conditions imposed by <br />paragraph (3)(b) of the Joint Stipulation, as clarified in this adequacy item. <br />Response #14(c) <br />As requested, the Wildcat Mining acknowledges the requirements of the Joint Stipulations <br />and states that these are addressed in the attached revised Exhibit D. See Attachment E-1. <br />The surface and groundwater fifth quarter water quality sample will be obtained May 15, <br />2011. Water quality sample results are presented in the attached Exhibit T. The proposed <br />mine plan has been modified to prevent potential impacts to surface and groundwater <br />quality while committing to a long term surface and groundwater monitoring program to <br />demonstrate compliance with applicable regulations. Because of major commitments to <br />mitigating potential environmental impacts prior to and during mining, Wildcat Mining <br />respectfully submits that limitations to commencing mining operations are not appropriate. <br />Revised <br />4/14/2011 <br />9
