5. On page vi, List of Maps, please correct Map 11 a to read Apache Canyon
Shafts and correct Map 13a title for the silo drainage as per TR-55. Also,
Map 6 should be identified as Surface Bedrock and Geology (Refuse Area).
6. Pages 2.04-11 a to 11 g cannot be inserted into the hard copy of the
approved permit because current page 2.05-11 is a two sided page with
2.05-12 on the second side.
7. Existing Table 7 on page 2.04-18 is being inadvertently eliminated by the
revised materials.
8. On page 2.04-24 the text narrative states "windmills south of the river are
owned by WFC". Please correct the permit text to properly identify windmill
ownership.
Rule 2.05 Operation and Reclamation Plan
9. Please ensure that permit text narrative on or around page 2.05-3 clearly
states what mining activities are proposed under PR-02, while retaining all
previous mine plan approval narrative. Reference to Map 3 is appropriate.
10. What additional surface and ground water monitoring is proposed for the
mine plan proposed under PR-02?
11. Please find attached a letter from the Division of Wildlife. The Division of
Wildlife is concerned about the additional disturbance and excavation
required to protect water and gas pipelines under the plan proposed in
Exhibit 24 for subsidence control and mitigation. The disturbance, the extent
of the disturbance, the length of time that excavated areas would be
exposed, hazards of same to wildlife and to users of the roadways, and final
reclamation of the disturbance are their primary concerns. Please provide a
response in the form of additional information as required as part of Exhibit
24 or as permit text narrative under Rule 2.05.6(6).
Rule 2.10 Maps and Plans
12. On Map 5, please modify the legend to properly display the stratigraphic
order of the formations with the Pierre Shale being the oldest formation,
followed by the Trinidad sandstone.
13. On Map 6A - 3, Apache Seam Thickness, the detail is showing the Maxwell
seam outcrop. Similarly, on Map 6A-4, Apache Seam Coal shows the
Maxwell seam in the detail.
