Frentress Gravel Pit, File M-2011-017,110c Permit Application Adequacy Issue (2) <br />Dustin: <br />Thanks for your correspondence of earlier today regarding our remaining outstanding permit application <br />issues requiring attention and commitments. We have reviewed your comments, and would offer the <br />following commitments: <br />1. No water used for any aspect of the operation, specifically including dust control in addition to <br />any material processing, will be used without the appropriate water rights in place and <br />approved by the Division of Water Resources (DWR). We have applied for change of use for <br />some of the property water rights from agricultural to industrial. Only water sources and <br />supplies approved for industrial use will be used for water for this operation, including permit <br />dust control uses. <br />2. The operation will never have more than 1,200 linear feet of unreclaimed, mining highwall open <br />and in-progress at any time with our mining and reclamation processes. For purposes of <br />reclamation, this is the maximum length at any given time that would need to be restored to the <br />required final grading slopes of 3H:1V or less. <br />Dustin, it is my understanding that this fully and completely addresses outstanding issues with regards <br />to our current 110c permit application. If that is not the case, or you need additional information from <br />Breeze Basin Resources, Inc., please do not hesitate to contact me directly.
