OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following permits are needed for the site: <br />1. County Special Use Permit - A Special Use Permit through Mesa County will be <br />required prior to being able to mine the Craig Ranch Pit <br />2. CPDES storm water discharge permit - A CPDES process water discharge permit will <br />not be needed from the Colorado Department of Public Health and Environment since <br />water will not leave the site. <br />3. APEN - A fugitive air emissions permit is needed from the Colorado Department of <br />Public Health and Environment since the site will mine more than 70,000 tons per year. <br />Air emissions permits will be in place for all portable equipment utilized on site which <br />requires a permit. The APEN has been submitted. <br />4. A CDOT Road Access Permit will be required for vehicles entering Highway 141. <br />5. A Spill Prevention Control and Countermeasure (SPCC) Plan is not needed for the <br />mining operation since the only tanks that will be located on site will be associated with <br />the individual processing plants or onsite tanks will be less than 650 gallons. At times <br />when there are no tanks on site with the processing equipment, fuel will be brought to the <br />site with a mobile fueling truck. No spilled material will be allowed to leave the site and <br />all tanks will have secondary containment. In addition, the portable crusher, wash plant <br />and portable asphalt plant that will be on site from time to time will have an individual <br />SPCC Plans. <br />6. No USCOE 404 permit will be necessary because no wetlands or waters of the U.S. will <br />be disturbed. <br />Craig Ranch Pit, March 2011 M-1
