State Street Director <br />Chicago, IL 60609 <br />Subject: GSL/Brush LLC, 120th Estates Partners Mine; File M-2001-085, Amendment <br />Application AM-05 Second Adequacy Review ?- <br />Dear Mr. Newman: <br />The Division of Reclamation, Mining, and Safety (Division) received on 8 April 2011 your email <br />response to our first Adequacy Review for the Amendment application AM-5. Your response does not <br />adequately address the Division's concerns. Please respond to the remaining adequacy issues <br />described below. <br />1) Application Form Section 3.1. Please clarify the acreage to be added under Amendment AM-5. If <br />the acreage to be added is +2.0 acres, then you must submit a revised Exhibit C Mining Plan Map <br />depicting the amended area. If the acreage to be added is as depicted on the "Amendment Application <br />Site Boundary" on Exhibit C Mining Plan, then you must submit a revised Application Form Section <br />3.1 showing the correct acreage. <br />2) The applicant has stated that only barley will be used for reseeding, whereas the seed mix specified <br />in the original application is as follows: <br />Common Name Lbs/Acre <br />Wcstcrn Whetatgrass 16 <br />Sideoats Grama 1.5 <br />I31ue Grama 0.4 <br />Needle and 7lread 1.7 <br />Streambank Wheatgrass 2.5 <br />Slender Wheatgrass 2.5 <br />Note: Seeding rates represent a drill rate <br />drill rate. <br />Percent of Mix <br />20 <br />15 <br />15 <br />to <br />20 <br />20 <br />Broadcast rate would be two tinges the <br />Barley is not a perennial grass and will not provide the long-term stability required by the Division. It <br />is an annual cereal grain that might provide cover for one growing season. If the Applicant is able to <br />develop the site by next spring, minor amounts of volunteer barley may come back, but with high risk <br />of annual and possibly perennial weeds. For that reason, the Division will require planting of perennial <br />grasses on this site.
