CM0001506 <br />STAFF REPORT: Climax Mine File No. 1041-0072 <br />BoCC Hearing Date: June 24, 2008 <br />• <br />(23) The Project will not result in unreasonable risk of releases of hazardous materials. <br />There will be no unreasonable risk of releases of hazardous materials as a result of the Project. Diesel <br />fuel for use by the backup emergency generator and any lubricants used for maintenance activities will be <br />appropriately managed in accordance with the site-wide SPCC plan, in accordance with federal <br />regulations at 40 CFR Part 112. Other than these petroleum-based products, no other hazardous <br />materials are required to maintain day-to-day operation of the Project. <br />[+] FINDING: (23) Hazardous materials. The Project WILL NOT result in unreasonable risk of the <br />release of hazardous materials. <br />(24) The benefits accruing to the County and its citizens from the Project outweigh the <br />losses of any natural, agricultural, recreational, grazing, commercial or industrial <br />resources within the County, or the losses of opportunities to develop such resources. <br />There are no identified losses of, or losses of opportunities to develop, any natural, agricultural, <br />recreational, grazing, commercial or industrial resources within the County. <br />• <br />[+] FINDING: (24) Benefits outweigh losses. The benefits accruing to the County and its citizens <br />WILL outweigh the losses of any natural, agricultural, recreational, grazing, commercial or industrial <br />resources within the County or the losses of opportunities to develop such resources. <br />B. Pursuant to Eagle County Land Use Regulations Section 6.04.02, Additional Criteria Applicable to <br />Municipal and Industrial Water Proiects, and as more specifically described in the application <br />materials, the following additional analysis is provided. <br />Water reuse and conservation is emphasized in all aspects of the site-wide water management system. <br />The Robinson Lake Pump Station Replacement Project emphasizes the efficient reuse and recycling of <br />process water, to minimize the need for the addition of any outside source of water and to minimize the <br />quantity of water which may require final treatment prior to discharge. <br />[+] FINDING: (1) Efficient use.
