Box 5660 <br />Frisco, CO 80443 <br />4-"5, si fo 53 <br />Subject: Climax Mine - Robinson Lake Reclaim Pipeline <br />Dear Jim: <br />On behalf of Climax Molybdenum Company, we are providing additional information <br />regarding the Robinson Lake Reclaim Water Pipeline project at the Climax Mine. <br />As we have discussed one of the facility upgrade projects being undertaken by Climax is <br />the replacement of the Robinson Lake Pump Station, located in Eagle County. This pump <br />station is part of the process water reclaim system which allows for the recycling and re- <br />use of water from the tailing impoundments. The new Robinson Lake Pump Station will <br />replace a system that was installed in 1936. In addition to the construction of the <br />replacement pump station, the pipeline from the pump station to the mill (located in Lake <br />County) will also be replaced. The location of the pump station and the pipeline alignment <br />are illustrated on the attached site location map (Figure 1). As indicated on this figure, <br />approximately 4,000 feet of this pipeline crosses Summit County along the southern edge <br />of the Robinson Tailing Storage Facility. The entire length of this pipeline will be buried <br />approximately 6 feet below existing grade. <br />As you are aware the Robinson Lake Pump Station Replacement project was the subject <br />of a 1041 application in Eagle County, submitted in May of this year. Summit County was <br />provided a copy of this application as a referral agency. This 1041 permit application was <br />approved by the Eagle County Board of County Commissioners on June 24, 2008. While <br />Climax believed that the entire Robinson Lake Pump Station project was exempt from <br />Eagle County 1041 Regulations, Eagle County requested that the project go through the <br />1041 permit process, in part due to concerns over the protection of Eagle Park Reservoir. <br />As a result we have viewed the pipeline as a minor element of the project and concluded <br />that the buried pipeline through Summit County does not constitute a water supply project <br />under Summit County regulations as it is not associated with providing water from or to <br />any storage or distribution system, or otherwise affect water storage or use, within Summit <br />County. <br />Tetra Tech <br />4900 Pearl E.
