CMO001313 <br />Findings of Fact, Conclusions of Law, Judgment and Decree <br />Case Nos. 92CW233 and 92CW336 - Page 39 <br />is <br />4.1.7 Miscellaneous Water Use. In addition to the above use of water at the <br />Climax Mine, water is used and consumed in concrete hatching, the domestic water system, and <br />in various types of equipment, water tanks, and ponds that are used for beneficial purposes at the <br />Climax Mine. <br />4.2 Historic Diversions Under the Subject Water Riahts. Climax Mine engineering <br />staff has maintained detailed records of streamflows and diversions at the Climax Mine. As part <br />of this data gathering effort, Parshall flumes and other water measurement devices have been <br />used at over forty locations at the Climax Mine. Nevertheless, maintenance of continuous, <br />accurate, and comprehensive records is hampered by the complexity of the water systems, the <br />mixing of newly diverted water with reused water, severe climatic conditions, and rough terrain. <br />Accordingly, Applicant's consultant engineers constructed a model to calculate the historic <br />diversions made under the Subject Water Rights while the rights were in priority. The terms and <br />conditions contained in Article 6 below are based upon these calculations. <br />4.3 Historic Use and Stream Depletions of the Subject Water Rights. <br />4.3.1 Categories of Consumptive Use. Applicant's consultant engineers have <br />determined that there are the following three general categories of consumptive water use at the <br />Climax Mine: <br />a. Constant Rate Consumptive Uses. Uses that result in a fairly <br />constant rate of consumption during active mining and milling, regardless of production rates, are <br />mine and mill ventilation, concrete batching, steam losses, and miscellaneous evaporative losses. <br />For the production period of 1976 through 1981, the average amount for this category of <br />consumptive use was 215 acre feet per year. <br />t <br />56642.
