CM0001298 <br />Findings of Fact, Conclusions of Law, Judgment and Decree <br />Case Nos. 92CW233 and 92CW336 - Page 24 <br />• depletions by the Climax Water SuPP1Y System is, as described herein feasible. In addition <br />, <br />physical measurement of water delivered from the Climax Water Supply System occurs on <br />Tenmile Creek at the Climax Mine Property Line Flume, and on the East Fork of the Eagle River <br />shortly below Eagle Park Reservoir. The components of the Climax Water Supply System which <br />will facilitate the diversion of water are described below. However, the Applicant seeks the right <br />to modify these components as necessary for water delivery purposes, provided that: such <br />modifications do not otherwise affect the terms and conditions imposed herein; the State <br />Engineer is notified; and said modifications are reflected in an accounting form approved by the <br />State Engineer. <br />3.2.1 The Kokomo Creek Flume. The Kokomo Creek Flume diverts water of <br />Kokomo Creek at a maximum rate of 25.0 cfs at a point whence the southeast comer of Section <br />22 in Township 7 South, Range 79 West, 6'h P.M. bears south 57°48' east a distance of 2780 feet. <br />3.2.2 The Searle Creek Flume. The Searle Creek Flume diverts water of Searle <br />Creek at a maximum rate of 35.0 cfs at a point whence the southeast comer of Section 15 in <br />Township 7 South, Range 79 West, 6d' P.M. bears south 54°13' east a distance of 3440 feet. <br />3.2.3 The West Interceptor Ditch. The West Interceptor Ditch runs <br />northeasterly on the northwest side of Robinson and Tenmile Ponds to Kokomo Creek, thence <br />northerly to Searle Gulch, thence generally easterly along the northwest side of Mayflower Pond <br />and into Tenmile Creek below the Mayflower Pond. The West Interceptor Ditch diverts surface <br />flow, seepage, and run-off from watersheds above it that are tributary to Tenmile Creek at a <br />maximum rate of 15.0 cfs. The West Interceptor Ditch also diverts water of Kokomo Creek at <br />the rate of 25.0 cfs at a point whence the Southeast comer of Section 22 in Township 7 South, <br />r <br />56642. WPD:S
