CM0001337 <br />Findings of Fact, Conclusions of Law, Judgment and Decree <br />Case Nos. 92CW233 and 92CW336 - Page 63 40 <br />In addition, the volume of water available for lease shall be further limited by the provisions of <br />paragraph 6.3.1. <br />CONCLUSIONS OF LAW <br />7 Based upon and fully incorporating herein the findings of fact set forth above, this Court <br />concludes as a matter of law the following: <br />7.1 Personal and Subject Matter Jurisdiction. Timely and adequate notice of the <br />pendency of these proceedings in rem has been given in the manner required by law. The time <br />for filing statements of opposition and for seeking leave to intervene has expired. This Court has <br />subject matter jurisdiction over the applications and these proceedings, and personal jurisdiction <br />over all persons who would have standing to appear as parties, regardless of whether they have <br />appeared. • <br />7.2 Proposed Applications are Lawful. The proposed applications for changes of <br />water rights, and the terms and conditions herein, are authorized by the Water Right <br />Determination and Administration Act of 1969, C.R.S. §§ 37-92-101 to -602 (1990) (the "1969 <br />Act"), and C.R.S. § 37-90-137(7), and can be implemented in accordance with said statutes. <br />7.3 No Iniuryto Other Water Rights. So long as there is compliance with and proper <br />administration of the protective terms and conditions set forth herein, the changes of water rights <br />requested herein cannot, as a matter of law, result in material injury to the owners or users of <br />water under vested water rights or decreed conditional water rights. <br />JUDGMENT AND DECREE <br />8 Based upon the foregoing Findings of Fact and Conclusions of Law, it is hereby <br />ORDERED, ADJUDGED, AND DECREED BY THE COURT: <br />• <br />56642.
