Furrows <br />must be periodically re -cut, in order to repair damage caused by livestock, wildlife, and <br />irrigation use. We observed nothing about the sideroll irrigated area that would preclude <br />future establishment of furrow irrigation following final bond release. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />• Weather conditions were dry and somewhat windy throughout the inspection. The water <br />truck was observed numerous times, spraying down the vehicle traffic areas. No wind <br />erosion of topsoil from stockpiles or replaced zones was observed. <br />• During the records check, Mr. Gubka informed us that WFC has applied for a new Air <br />Pollution Emission Notice (ADEN) to renew the mine's Emissions Permit. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />• Permitting records were available for review at the New Horizon Mine office. A completed <br />DRMS Availability of Records form is included with this report. <br />• Public records were available for viewing at the Montrose County Courthouse — Nucla <br />Annex. A full set of the permit binders was present, as was the application for SL -12. <br />EXPLOSIVES — Rule 4.08 <br />Distance Prohibitions 4.08.4; Warnings 4.08.4; Control of Adverse Effects 4.08.4: <br />• Shortly after noon on March 29th, we had the opportunity to observe a blast (Photo 4). The <br />blast was located near the southern end of the permit area, on the Morgan property. Due to <br />the proximity of the Frank Morgan home, only one additional shot to the south is planned for <br />the current cut. Mr. Gubka explained that the blast we observed was triple- decked, and he <br />described the layered process of loading the drilled holes with explosives and stemming. <br />• Prior to the blast, we accompanied Mr. Gubka as he placed sandbags on top of seismographs <br />located on the properties of Frank Morgan, Pat Enstrom, and Nancy Enstrom. WFC has five <br />seismographs available for use; three were utilized for this blast. Prior to a blast, the corners <br />of the drilled pattern are surveyed using GPS, and the distance to the nearest structure is <br />computed. <br />• The New Horizon Permit includes a waiver to the Scale- Distance formula, due to the level of <br />detail used in individually designing each blast. <br />FISH and WILDLIFE — Rule 4.18: <br />• At Ponds 007 and 011, a variety of waterfowl were sighted, including great blue herons, <br />Canada geese, and migratory bufflehead; lesser scaup; avocet; and common merganser. <br />• Prairie dogs continue to occupy the as- yet - unmined western portion of the WFC parcel in the <br />northwest corner of the permit area. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures <br />4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; <br />Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments <br />4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Number of Partial Inspection this Fiscal Year: 6 <br />Number of Complete Inspections this Fiscal Year: 3 Page 3 of 16 <br />
