State Street Director <br />Chicago, IL 60609 <br />Subject: GSL/Brush LLC, 120th Estates Partners Mine; File M-2001-085, Amendment <br />Application AM-05 Adequacy Review <br />Dear Mr. Newman: <br />The Division of Reclamation, Mining, and Safety (Division) has reviewed the Amendment application <br />AM-5 that was submitted to the Division on 17 March 2011, and has identified the issues listed below <br />that must be resolved before we can approve the Amendment. <br />1) Application Form Section 3.1. The form states that the change in acreage will be +2.0 acres. <br />However, the boundary labeled as "Amendment Application Site Boundary" on Exhibit C Mining Plan <br />appears to delineate an area that is approximately 1,000 ft on each side and is therefore substantially <br />greater than 2.0 acres. Please clarify. <br />2) The applicant has stated that only barley will be used for reseeding, whereas the seed mix specified <br />in the original application is as follows: <br />Common Dame Lbs/Acre <br />Western whcatgrass 3.6 <br />Sideoats Grama 1.5 <br />Blue Grarna 0.4 <br />Needle and llucad 1.7 <br />Streambank Wheatgrass 2.5 <br />Slender Wheatgrass 2.5 <br />Note: Sceding rates represent a drill rate. <br />drib rite. <br />Percent of Mix <br />20 <br />15 <br />is <br />10 <br />20 <br />20 <br />Broadcast rate would be two tinies the <br />Barley is not a perennial grass and will not provide the long-term stability required by the Division. <br />Therefore, the Applicant must commit to using the seed mix that was approved in the original <br />application for the amended area as well. <br />3) Please describe all potential future uses of the amended area after the currently stockpiled material <br />has been removed. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand )unction • Durango Active and Inactive Mines
