Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) received copies of landowner <br />notification letters dated March 29, 2011. The land owner notifications were sent to comply with the <br />following Rule(s): <br />• Rule 4.20.2 - The land owner notification was distributed to all owners of property and <br />residents within the area above underground workings and adjacent areas. <br />• Rule 4.20.2(1) - The notifications identified specific areas in which mining will take place. <br />• Rule 4.20.2(2) - The notifications provided dates of mining activities that could cause <br />subsidence and affect structures. <br />• Rule 4.20.2(3) - The notifications did not include measures to be taken to prevent or control <br />adverse surface effects. However, only continuous mining operations are permitted and <br />approved with no subsidence affects anticipated. <br />The landowner notifications provided to the Division comply with Rule 4.20.2. Please note that the <br />above referenced notifications provide a start date of October 1, 2011. If mining is to occur previous <br />to 6 months from the March 29, 2011 date of the landowner notifications, compliance with Rule 4.20.2 <br />will not be met. <br />If you have any questions feel free to contact me.
