CM0000654 <br />Mr. Eric Scott <br />Climax Mine - Response to DRMS Adequacy Review Comments <br />• Permit M-1977-493; Amendment AM-06 <br />March 1, 2011 <br />Page 9 of 16 <br />• Observatory quonset building near Chalk Mountain Reservoir, housing monitoring equipment <br />associated with the former Observatory (building, but not underlying property, owned by the <br />University of New Hampshire) <br />Both Eagle Park Reservoir and Clinton Reservoir were previously owned by CIVIC. The Purchase <br />and Sale Agreement for the Eagle Park Reservoir, and the Clinton Reservoir Purchase Agreement <br />each contain language sufficient to demonstrate compliance with the intent of the referenced <br />requirements. In general, the agreement language provides assurance to these owners that CIVIC <br />shall not conduct operations, or allow operations to be conducted in such a manner as may <br />adversely impact the associated structures. <br />Damage Reimbursement Agreement letters have been sent to the owners of the other structures, <br />copies of which are provided in the revised Exhibit S, attached. <br />Exhibit U - DMO Environmental Protection Plan (EPP) <br />Exhibit U/Section (2) Maps Comment Please submit a map of the mill facility, water treatment <br />facility, and any other facility on site that depicts the locations of and how designated chemicals <br />will be stored and used, and in what quantities. <br />• Response: Two additional figures (AM-06-T-06 and AM-06-T-07), attached, have been prepared <br />to present additional detail of the mill facility; showing the locations of where and how designated <br />chemicals will be stored and used and in what quantities. Also attached is a revised version of <br />Table T-2 from the EPP that includes the quantities of designated chemicals to be stored on-site. <br />Water treatment chemicals are not identified as designated chemicals and therefore maps of the <br />existing water treatment facility (the Sludge Densification Plant, or SDP) have not been provided. <br />The construction of the SDP was approved by the DRMS as part of AM-05, which was submitted <br />in 2005. Also, as discussed with DRMS in the meeting with CIVIC on February 4, 2011, the EPP <br />will be updated following approval of AM-06 to incorporate all DRMS comments, as appropriate, <br />for DRMS review and approval before full-scale mining and milling operations resume. <br />Exhibit U/Section (2) Comment. Please also describe the measures that will be taken to prevent <br />and monitor for releases of these materials and what measures will be taken in the event of a <br />release. If this information is contained in the approved site SPCC/MCP, please reference as <br />appropriate and include a copy of this document or the applicable referenced sections. <br />Response: Specific measures that will be taken to prevent and monitor for releases of designated <br />chemicals are described in the revised EPP to be submitted to DRMS as referenced in the <br />response to the previous comment. In addition, Measures taken in the event of a release are <br />discussed in the previously submitted Designated Chemicals Emergency Response Plan, included <br />as Appendix T-B of the EPP. <br />0
