Permit Amendment (AM-06) - Climax Mine <br />CM0000711 <br />Climax Molybdenum ComPan <br />Y <br />Permit M-1977-493 <br />Exhibit S - Permanent Man-Made Structures <br />Permanent Man-Made Structures, not owned by CIVIC, located within 200 feet of the operation or affected <br />land, include structures owned by Colorado Department of Transportation, Xcel Energy, Qwest <br />Communications, Fremont Pass Ditch Company, Clinton Ditch and Reservoir Company, Eagle Park <br />Reservoir Company and the University of New Hampshire. <br />Both Eagle Park Reservoir and Clinton Reservoir were previously owned by CIVIC. The Purchase and <br />Sale Agreement for the Eagle Park Reservoir and the Clinton Reservoir Purchase Agreement each <br />contain language sufficient to demonstrate compliance with Rule 6.4.20 (Previously Rule 6.4.19). In <br />general, the agreement language provides assurance to these owners that CIVIC will not conduct <br />operations, or allow operations to be conducted in such a manner as may adversely impact the <br />associated structures. Damage Reimbursement Agreement Letters have been sent to the owners of the <br />other structures, copies of which are provided in this Exhibit. A list of these owners, followed by a list of <br />the structures/features, is provided below.
