Clinton is <br />concerned about the proposed amendment to the Climax Mine permit and requests party status <br />and an opportunity to be heard at a hearing before the Mined Land Reclamation Board <br />("Board"). The stated purposes of the proposed amendment are to adjust the affected land <br />boundary to encompass areas needed for planned future mine operations, as well as to update the <br />mining plan to accommodate the resumption of mineral extraction and production at the mine. <br />The resumed mining activities include significant expansion of the open pit mine, and <br />correspondingly large expansions of overburden storage facilities and tailings ponds. <br />Clinton owns property that is within the proposed new affected land boundary. The <br />Clinton Gulch Reservoir is immediately adjacent to the proposed new boundary. Clinton is <br />concerned that it may be adversely impacted by the proposed mining activities, including adverse <br />impacts to the prevailing hydrologic balance of the affected lands and of the surrounding area, <br />and to the quantity and quality of surface and ground water. <br />Exhibit 4
