By letters dated July 8, 2010, each of the entities expressed their concerns
about the potential adverse water quality and water quantity impacts of the proposed amendment
to the Climax Mine permit. Each entity also requested party status and the opportunity to be
heard by the Mined Land Reclamation Board.
As you know, subsequent to the referenced July 8 letters, Climax submitted a proposed
amendment to the earlier request to amend the mining permit. Please consider this letter notice
that our clients request party status as to all of the proposed amendments, and request a hearing
to comment on possible water quality and water quantity impacts of the amendments. We
remain optimistic that acceptable protective terms and conditions can be negotiated with Climax,
41381
Exhibit 5
