Room 215 <br />Denver, CO 80203 <br />Climax Mine <br />Hwy. 91 <br />Climax, CO 80429 <br />Phone (719) 486-2150 <br />Fax (719) 486-2251 <br />RE: Modification of Amendment Application (ANI-06) to the Climax Reclamation Permit <br />Dear Allen: <br />In a July 22, 2010 correspondence, the Climax Molybdenum Company, Climax Mine (Climax) <br />formally requested that the Division delay full review of the amendment application (AM-06) which <br />was submitted to the Colorado Mined Land Reclamation Board (MLRB) in May, 2010. The purpose <br />of this submittal was for amending Climax's Reclamation Permit (M-1977-493). This delay was <br />requested until such time as necessary modifications to the application, identified after the original <br />submittal, could be developed and submitted. <br />• Accompanying this letter are five copies of the relevant changes referenced above which include <br />replacement pages and revised drawings. Climax has provided notice to the appropriate Boards of <br />County Commissioners and Soil Conservation Districts, posted appropriate notices at the mine site, <br />and has updated all public review copies of the application with these relevant changes. Once <br />Climax receives notice from the Division that the amended application is considered to be filed, <br />within 10 days Climax will proceed with the remaining public notice requirements. <br />If you have questions or comments, please don't hesitate to contact me at (719) 486-7718. <br />Sincerely, <br />Brian D.
