11794-2 - <br />Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and <br />Safety has issued a proposed decision to Partially <br />approve Bond Release Application No. 3 (SL-3) for <br />the Seneca II-W Mine, Permit No. C-1982-057. The <br />mine is operated by Seneca Coal Company, LLC un- <br />der the provisions of the Colorado Surface Coal Min- <br />ing Reclamation Act of 1979. The bond release ap- <br />plication was submitted by Seneca Coal Company, <br />LLC on July 14, 2010. The Division is proposing to <br />approve Phase I bond release on 412.35 acres of <br />disturbed area where Seneca Coal Company has <br />completed backfilling, grading, and drainage rees- <br />tablishment. The release area includes 29.4 acres in <br />the original permit area and 382.95 acres in the <br />South Extension Area. The affected area is located in <br />Routt County, approximately 9 <br />den miles South of Hay- <br />, Colorado. <br />Copies of the proposed decision are available for re- <br />view at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, <br />Denver, Colorado 80203, and at the office of the <br />Hayden Public Library. <br />Any person who has an interest which is or may be <br />adversely affected may request an adjudicatory <br />hear- ing regarding this proposed decision. Requests fora <br />hearing must be made in writing within thirty (30) <br />days of the first publication of this notice, and shall <br />state with reasonable specificity the reasons for the <br />request and objections to the proposed decision. <br />Published in The Steamboat Pilot & Today <br />First Publication Date.
