use of the Uhlenhopp Well in Case No. 97CW234 to allow its use for <br />commercial feedlot and agricultural purposes. <br />f) Location: NW1/4 SE1/4 of Section 33, Township 4 North, Range 55 West, <br />6`" P.M., Morgan County, at a point 1,500 feet North and 2,715 feet East of <br />the Southwest corner of said Section 33. <br />3) Calculation of Depletions. <br />a) Pinneo Feedlot Wells: <br />(1) Pinneo acquired and began to operate its feedlot in 1991. Each Pinneo <br />Feedlot Well has been equipped with a totalizing flow meter to <br />measure well pumping since May 2002. Pinneo's uses of well water at <br />the feedlot include drinking water for the cattle (including delivery of <br />additional water to prevent freezing of water troughs), dust control, <br />pen sprinkling, and land application of pumped water on adjacent land <br />to allow for disposal of nutrients in the process water at agronomic <br />rates. All of these uses are considered to be 100 percent consumptive. <br />Pinneo's previous unmetered water use has been estimated based upon <br />a correlation of metered pumping and previous cattle population/head <br />count data for the feedlot, using the ratio of 10.7 gpd/head based upon <br />metered pumping records. <br />(2) Between 1983 and 1991 the feedlot was not in operation. Prior to <br />1983, Pinneo's predecessor in interest operated a smaller feedlot on <br />the site, then known as the Boxer Feedlot. Actual monthly head <br />counts are unavailable for this time period, but it is reasonable to <br />estimate that the Boxer Feedlot averaged about 14,000 head of cattle <br />per year. Unlike Pinneo's operation of the feedlot, the Boxer Feedlot <br />relied on heaters rather than additional well pumping to prevent <br />freezing during the winter. Also, the Boxer Feedlot had no developed <br />dust control system in place, and in fact, prior to 1985, applicable <br />regulations did not require dust control. Estimated water use at the <br />Boxer Feedlot thus averaged about 8.5 gpd/head, and was reasonably <br />constant throughout the year. <br />b) Uhlenhopp Well: <br />(1) Pinneo acquired the Uhlenhopp Well in 1996. Despite obtaining <br />approval of a change of use of the Uhlenhopp Well in Case No. <br />97CW234, Pinneo has never pumped or used the Uhlenhopp Well for <br />any purpose. In January 2010, Pinneo formally plugged and <br />abandoned the Uhlenhopp Well. <br />7of33
