approved by this Court, or a substitute water supply plan approved by the State <br />Engineer pursuant to C.R.S. § 37-92-308(4), providing for replacement of all out- <br />of-priority depletions that will result from use of the Booth Farm Well Right for <br />augmentation and replacement purposes, including by recharge. Pinneo shall not <br />pump the Booth Farm Well outside of the historical irrigation season unless such <br />use is approved pursuant to such a court-approved augmentation plan. <br />2) On or before April 1 of each year, Pinneo shall notify the Water Commissioner <br />and UPBCC whether the Booth Farm Well Right will be used for augmentation <br />and replacement purposes that year. In any year in which Pinneo uses the Booth <br />Farm Well Right for augmentation and replacement purposes, it shall not use such <br />right for irrigation. <br />3) Consumptive use/augmentation credit from the Booth Farm Well Right for <br />augmentation and replacement purposes shall be limited to 60% of the amount <br />pumped, up to a maximum of 81 acre-feet per year, subject to further reductions <br />after delivery to the Booth Farm Recharge Ponds as described in Paragraphs <br />10(A)(2)(e)(2) and 10(A)(2)(e)(3) . If Pinneo seeks to deliver such water to the <br />UPBCC discharge structure described in Paragraph 10(B)(1)(b) , it shall obtain <br />UPBCC's consent to such delivery. The remaining amount of water pumped (i.e., <br />40%, up to a maximum of 54 acre-feet per year) shall be delivered to the Booth <br />Farm Recharge Ponds and shall accrue to the river as delayed return flows and, <br />upon such delivery of such remaining amount to the Booth Farm Recharge Ponds, <br />Pinneo shall be deemed to have satisfied its return flow obligations with respect to <br />use of the Booth Farm Well Right for augmentation and replacement purposes for <br />that year. <br />D. Credits under Pinneo Surplus Credit Recycling Exchanges: Deliveries of water under <br />the Pinneo Surplus Credit Recycling Exchanges shall be measured daily at the <br />headgate of the Upper Platte and Beaver Canal, described in Paragraph 10(B)(2)(b), <br />and again at the measuring devices for the Booth Farm Recharge Ponds or UPBCC <br />recharge facilities, as more particularly described in the UPBCC Augmentation Plan, <br />and shall not exceed the daily amount of Pinneo's surplus augmentation and <br />replacement credits. Recharge accretions resulting from deliveries to such recharge <br />facilities shall be calculated therefor as described in Paragraph 28(F) . Exchanges <br />may only be made if there is a live stream between the points of exchange. <br />E. Recharge Accretions via Booth Farm Recharge Ponds: Pinneo will measure and <br />calculate recharge accretions from deliveries of water under the Jackson Lake Rights, <br />the Booth Farm Well Right, or the Pinneo Surplus Credit Recycling Exchanges to the <br />Booth Farm Recharge Ponds as described in Paragraphs 10(A)(2)(e)(2) and <br />10(A)(2)(e)(3). <br />29. Replacement of Out-of-Priority Depletions: Available replacement credits under this <br />plan for augmentation shall equal or exceed all out-of-priority depletions calculated <br />hereunder in every month.
