C. Uhlenhopp Well Depletions: Pinneo has abandoned the Uhlenhopp Well and thus <br />need not read any meter for the Uhlenhopp Well, but shall continue to replace out-of- <br />priority post-pumping depletions from prior pumping of the Uhlenhopp Well until <br />there are no longer any post-pumping depletions occurring from such prior pumping. <br />D. Accounting for Lagged Depletions from Pre-Decree Water Uses: Pinneo shall <br />include in the determinations of Headley Recharge Project, Pinneo Feedlot Wells, and <br />the Uhlenhopp Well depletions all lagged depletions from past pumping of the wells <br />and gravel pit evaporation since March 15, 1974, calculated as described in <br />Paragraphs 9(A)(3), 9(A)(4), and 27(A). <br />E. Determination Whether Depletions Out-of-Priority: A senior South Platte River call <br />below some or all of the reach(es) where the depletions from the Pinneo Feedlot <br />Wells, Uhlenhopp Well and the Headley Recharge Project affect the South Platte <br />River, described in Paragraphs 9(A)(5)(b) and 10(A)(1)(a) , will determine when and <br />where replacement of such depletions is required under this plan. All such depletions <br />shall be deemed to be out-of-priority if the South Platte River call is senior to October <br />6, 1965 which is the priority date of the most junior of the Pinneo Feedlot Wells (i.e., <br />Jack Boxer and Son Well No. 4-10330-F). <br />28. Determination of Available Replacement Supplies: <br />A. Headley Recharge Project Credits: Except as may be modified elsewhere by this <br />decree, Pinneo will continue to calculate recharge accretions associated with the <br />operations under the Headley Recharge Project in accordance with the terms and <br />conditions of the decree entered in Case No. 90CW 189. The lagged augmentation <br />credits from the Headley Recharge Project, calculated based on the respective decreed <br />SDF factors, are multiplied by 0.5 to determine Pinneo's share. <br />B. Credits under Jackson Lake Rights: Releases of stored water shall occur during the <br />months of June through October or as otherwise approved by Jackson Lake Reservoir <br />and Irrigation Company, described in Paragraph IO(B)(1)(b)(2), and the Water <br />Commissioner. The augmentation credit from releases of water under Jackson Lake <br />Rights will be calculated as follows: <br />1) On or before April 1 of any water year, Pinneo shall notify the Water <br />Commissioner whether its Jackson Lake Rights will be used for augmentation and <br />replacement purposes that year. In any year in which Pinneo uses any of the <br />Jackson Lake Rights for augmentation and replacement purposes, it shall not use <br />any of the rights for irrigation. <br />2) When such Jackson Lake Rights releases are made for direct delivery to the <br />midpoint of Pinneo depletions under this plan, described in Paragraphs 9(A)(5) <br />and 10(A)(1)(a) , the amount of water so released, after the transit losses to such <br />midpoint of depletions have been calculated, will be further adjusted by a factor <br />of 47.3%, to assure that the augmentation credit does not exceed 39.74% of the <br />23 of 33
