4) UPBCC Augmentation of Booth Farm Well Right: Out-of-priority depletions <br />from use of the Booth Farm Well Right for irrigation of land in the UPBCC <br />service area are augmented pursuant to the UPBCC Augmentation Plan. The <br />UPBCC Augmentation Plan will not augment out-of-priority depletions from use <br />of the Booth Farm Well Right for any purpose other than irrigation of land within <br />the UPBCC service area. Thus, out-of-priority depletions resulting from use of <br />the Booth Farm Well Right as changed in this decree will not be augmented by <br />the UPBCC Augmentation Plan, but must be separately augmented. <br />B. Description of operation of plan for augmentation: <br />1) Pinneo will augment out-of-priority depletions attributable to pumping the Pinneo <br />Feedlot Wells and post-pumping depletions attributable to prior use of the <br />Uhlenhopp Well using surplus recharge credits that accrue to the stream in excess <br />of any augmentation requirements imposed by the Headley Recharge Project <br />decree. In the event of any shortfall in required replacement, Pinneo will take one <br />of the flowing actions: <br />a) Pinneo will release or recharge sufficient water available under the Jackson <br />Lake Rights, and/or, if available, the Booth Farm Well Right, and/or <br />additional sources added pursuant to Paragraph 29. <br />b) Consumptive use credits available to Pinneo under the Jackson Lake Rights <br />or, if available, the Booth Farm Well Right may accrue to the South Platte <br />River over time from delivery into the Booth Farm Recharge Ponds <br />described in Paragraph IO(A)(2)(e) above, or may (with the consent of <br />UPBCC) be delivered to a UPBCC discharge structure at a point on Beaver <br />Creek in the SETA of the SE1/4 of Section 35, Township 4 North, Range 56 <br />West of the 6t' P.M., Morgan County, Colorado. <br />(1) When used for augmentation and replacement purposes, pumping <br />under the Booth Farm Well Right shall be limited to 135 acre-feet for <br />the year in which it is so used. <br />(2) Use of the Jackson Lake Rights for the changed purposes shall comply <br />with all applicable bylaws, rules and regulations of Jackson Lake <br />Reservoir and Irrigation Company. Further, Jackson Lake Reservoir <br />and Irrigation Company shall not be required to release water pursuant <br />to this decree except upon proper notice to the Company and at those <br />times when the Jackson Lake Reservoir and Irrigation Company is <br />making releases of water within its normal operating policies and <br />procedures or at such other time determined by the Company to be <br />appropriate and pursuant to written agreement between the parties. <br />c) Water delivered to recharge in the Booth Farm Recharge Ponds under the <br />Jackson Lake Rights or pursuant to the appropriative right of exchange <br />18 of 33
