PERMIT #: M-1977-560 <br />INSPECTOR'S INITIALS: JLE <br />INSPECTION DATE: March 21, 2011 <br />of exposed ground water at the site that will need permanent augmentation. Based on the information <br />obtained from the engineering evaluation, the Operator will have a better idea of the final configuration of the <br />site. In the near future, the Operator intends to submit a Technical Revision to update the current approved <br />reclamation plan to account for the backfilling activities. This revision will also likely address the future <br />bonding implications associated with any remaining exposed groundwater. <br />The current approved reclamation plan includes a tree planting plan. This plan includes the requirement for <br />planting Russian olive trees at the site. At this time, Russian olive is considered a noxious weed and should not <br />be planted. Also, Mr. Brubaker indicated the state engineer would prefer if the company did not plant the <br />required cottonwood trees because of the amount of water they consume. The Division is not aware of this <br />issue. During the Technical Revision process, the Operator will need to update/change the current approved <br />tree planting plan. If they desire to remove the cottonwood planting requirement, they must submit evidence <br />from the State Engineer substantiating the reason for not planting the required cottonwood trees. <br />In regards to the batch plant/processing area. During the AM01 amendment process, this area was <br />designated to be reclaimed as a commercial site. Material stockpiles were to be removed and the site leveled <br />and graveled. The southern pond area was required to be sloped and the shores topsoiled and revegetated. <br />Page 3 of 7
