Pineda <br />Chester Barnard Director <br />Barnard Quarries <br />245 Evans Street <br />Lyons, CO 80540 <br />RE: Barnard Quarry; DRMS File No. M-1996-079; Follow-up on Unresolved Problems <br />Dear Mr. Barnard, <br />The above-mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our <br />records, the following problem was to be resolved on or before January 14, 2011. Listed below <br />are descriptions and corrective actions for the problem. Please resolve the corrective actions <br />and provide evidence of such resolution on or before May 6, 2011. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to <br />the Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />Problem Description: <br />• The site is improperly impounding surface drainage/runoff. <br />Corrective Action: <br />• The Operator shall obtain a Stormwater Discharge Permit through the Colorado <br />Department of Public Health and Environment or submit documentation from the State <br />Engineer's Office demonstrating that the impoundment of water in this pit is authorized <br />by that office. <br />If the problem has already been remedied, please provide evidence of its completion.
