RE: Frentress Gravel Pit, File No. M-2011-017, 110c Permit Application Adequacy Issue and Financial Warranty

Dear Mr. Domson:
The Division of Reclamation, Mining and Safety (Division) is currently reviewing the above noted 110c permit application
package in order to determine if it adequately meets the requirements of the Colorado Land Reclamation Act for the
Extraction of Construction Materials (Act). The following issue will require clarification:
Exhibit C - Mine Plan states that water from the Yampa River will be used during the operation for dust control
and product washing.
Please submit documentation to the Division that the landowner's water rights for the Yampa River allow for
industrial use.
Additionally, the Division has calculated an estimated adequate Financial Warranty amount for this site. Please review
the enclosed Bond Calculation worksheets and notify the Division if any errors or discrepancies are noted.
This letter shall not be construed to mean that there are no other technical deficiencies in your application. The Division
will further review your application to determine whether it is adequate to meet the requirements of the Act.
