Carbon Junction Mine (DRMS file C-92-080) DUBLIN Dear Sir or Madam: On behalf of my client, Oakridge Energy, Inc. ("OEI"), owner and permittee of the Carbon Junction Mine (CDRMS permit #C-1992-080) as well as the owner LONDON of the surface estate in the permit area, we hereby request pursuant to Rule 3.03.2(6) a formal adjudicatory hearing in Denver, Colorado before the Colorado Mined Land Reclamation Board on the Division's proposed decision dated March 11, 2011 (the "Decision") on OEI's application for Phase III LOS ANGELES (final) bond release at the Carbon Junction Mine (CDRMS Bond Release designation SL-04). Hearing Date PHOENIX OEI understands that pursuant to Rule 3.03.2(6)(a) the Board is required to hold a requested hearing within 30 days of the receipt of a written request. Nevertheless, OEI requests that the hearing on this matter be held not in April but rather at the Board's regular meeting in May. SALT LAKE CITY Summary The Division's Decision has proposed to approve Phase I and Phase II of the requested bond release, but has denied the Phase III (final) release. SAN FRANCISCO The Division contends in its Decision that OEI has not "substantially commenced" the development of the post-mining land use under Rule 3.02.3(2)(c).
