<br />Since first commenting on AM-06 in July of last summer, the District, Authority, Eagle <br />Park Reservoir Company and Clinton Reservoir Company have been clear and consistent in their <br />position that the proposed changes to the Climax mine permit amendment must protect the water <br />quality and quantity of both reservoir facilities. At the direction of the Division, these Objectors <br />attempted to negotiate an acceptable resolution of their concerns directly with Climax. Those <br />efforts involved many meetings over many months, and included experts and the exchange of <br />many draft proposed agreements. Unfortunately, no acceptable protection for water quality and <br />water quantity was secured. Division staff never requested or even remotely suggested that the <br />Objectors should provide staff with more detailed information about their concerns. Indeed, the <br />Objectors' full range of concerns cannot be known until the revised environmental protection <br />plan and water monitoring plan are developed and shared. Staffs request for more detailed <br />information on the nature of the Objectors' concerns in the absence of those documents further <br />illustrates how the cart has been placed before the horse in this process. To the extent they are <br />known at this time, many of the Objectors' more detailed concerns have been shared with <br />Division staff and are summarized above and in the exhibits that have been provided to the <br />Division and the Board.
