<br />The District and Authority have separate boards of directors, but are co-managed, and <br />collectively constitute the second largest municipal water provider on Colorado's western slope. <br />Eagle Park Reservoir is a principal source of augmentation water and water for all other decreed <br />uses for the District and Authority. <br />Eagle Park Reservoir is a 3,300 acre foot reservoir in the Eagle River basin that meets <br />domestic water supply standards, and is located directly downstream and adjacent to the western <br />boundary of the Climax property which is the subject of Climax's amended application. <br />The Eagle Park Reservoir Company is the owner of Eagle Park Reservoir and consists of <br />five shareholders. The shareholders include the District; the Authority; Vail Resorts, Inc., the <br />owner and operator of the Vail and Beaver Creek ski resorts and Red Sky Ranch residential and <br />golf resort; the Colorado River Water Conservation District, which provides augmentation water <br />from Eagle Park Reservoir to the area of Eagle County from Wolcott to the Towns of Eagle and <br />Gypsum; and the Board of County Commissioners of Eagle County, Colorado, which uses water <br />from Eagle Park Reservoir to meet the needs of properties it owns or has developed. <br />All together the shareholders depend upon the entire yield of Eagle Park Reservoir to <br />meet the municipal, domestic and augmentation demands of over 80,000 residents and guests in <br />Eagle County, and the domestic and snowmaking demands of the over 2.2 million annual guests <br />of the Vail and Beaver Creek ski areas, which are two of Colorado's largest ski resorts. <br />The Clinton Reservoir Company is the owner of Clinton Reservoir, which is a 4,500 acre <br />foot reservoir in the Ten Mile River basin that meets domestic water supply standards, and is <br />located adjacent to the eastern boundary of the Climax property which is the subject of the <br />amended application. <br />The shareholders of the Clinton Reservoir Company include the Board of County <br />Commissioners of Summit County, Colorado; the Towns of Breckenridge, Dillon and <br />Silverthorne; the Copper Mountain Consolidated Metropolitan District; and the Arapahoe Basin, <br />Breckenridge, Copper Mountain, Keystone and Winter Park Ski Areas. <br />All together the shareholders depend upon the entire yield of Clinton Reservoir to meet <br />the municipal and augmentation demand of over 44,000 residents and guests in Summit County, <br />Colorado, and the snowmaking and domestic needs of the largest ski resorts in Summit and <br />Grand Counties that collectively have over 5 million skier visits per year. <br />Objections to Eagle Park Reservoir Contamination from the Climax Mining QRerations <br />The "Description of Site," Section T-1.2 to the Climax Mine Permit Amendment (AM- <br />06) states: <br />"Ancillary fresh water facilities not owned by CMC, including Clinton <br />Reservoir and Eagle Park Reservoir, are important site features and part of <br />Climax's water management system." <br />44WS <br />2
