March 23, 2011 C- 1981- 022/Elk Creek Mine MPB <br />ROADS —Rule 4.03 <br />Construction 4.03.1(3)/4.03.2(3) <br />Drainage 4.03.1(4)/4.03.2(4) <br />Surfacing and Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) <br />Reclamation 4.03.1(7)/4.03.2(7): <br />The Elk Creek Haul and Access Roads, Bear Creek and Hubbard Creek Access Roads were all inspected. Bear <br />Creek Road was very muddy but accessible up to the location of the fan site. Road ditches and road culverts were <br />generally well maintained and road surfaces were graded and stable along all of the hauFaccess roads. Cut slopes <br />along these drainages were stable and no new slides or other damage was noted along any of the haul /access roads. <br />A portion of the Old highway 133 (the back entrance road to the mine) was being re- surfaced at the time of the <br />inspection. Road maintenance was necessary following the cleanup of the slide that occurred on January 4, 2011. <br />A section of the hillside located above this section of the road (east of the West Elk Loadout) slid and covered the <br />road. The slide repair work is done and this section of the road was being regraded. All other roads throughout <br />the permit area were in good condition. <br />SLIDES and DAMAGE - Rule 4.12: <br />The slide that occurred between MCC's West Elk Loadout and the Sanborn Creek fansite located along the old <br />Highway 133 has been fully mitigated and reclaimed. The material that blocked the road was moved to a CDOT <br />disposal site and a small amount was placed at the Substation No. 3. The hillside has been restored and large <br />riprap has been placed along the toe of the slide area to protect the road from further potential damage and to help <br />stabilize the slope. The slide repair area is shown in attached Photograph No. 2. <br />SUPPORT FACILITIES - Rule 4.04: <br />The West Valley Fill refuse pile was viewed from the entrance gate to the valley fill haul road. The refuse pile is <br />well vegetated and stable. The II -West refuse pile was not inspected due to poor road conditions. <br />The former Hubbard Creek fan and substation site were inspected. This area has recently been reclaimed by <br />removing the fan and associated facilities, the concrete has been demolished and the site backfilled. Backfill and <br />grading work remains to be completed at the site as soon as weather allows. The reclaimed Hubbard creek fan and <br />substation site are shown in attached Photograph No. 3. The Bear Creek fan site was operational and very well <br />maintained. <br />The Somerset Mine B -Seam Portals were inspected (see attached Photo No. 4). The reclaimed portals are stable <br />with good vegetation. <br />The reclaimed Sanborn Creek portals, the Sanborn Creek fan site, and Substation No. 3 were also inspected. These <br />facility locations are more sparsely vegetated but remain stable.
