2.05 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING ACTIVITIES - MINIMUM <br />REQUIREMENTS FOR OPERATION AND RECLAMATION PLANS. <br />final coal waste originated from the R -O -M coal stockpile located at the timber <br />storage area. By the end of the fourth quarter of 2008, topsoil had been placed <br />on the pile and the pile was seeded and mulched. With the placement of <br />topsoil the pile was covered with 4.0 feet of non -toxic cover. By the end of the <br />third quarter of 2009 the vegetative growth on the pile looked good <br />By letter dated October 9, 2009, technical revision 52 was submitted by the <br />Operator to terminate the quarterly inspection requirement for West Ridge coal <br />mine waste disposal area.. Rule 4.10.2(2)(a) states that, "Inspections may <br />terminate when the coal mine waste bank has been graded, covered in <br />accordance with 4.10.4(4), topsoil has been distributed on the bank in <br />— accordance with-4.06.4,-and revegetated or.at such a later- time -as- the - Division <br />may require." <br />Based on the above discussion the requirements of Rule 4.10.2(2)(a) have <br />been satisfied so the quarterly inspections of the West Ridge coal mine waste <br />disposal area will terminate. The final inspection of the coal mine waste pile <br />occurred during the fourth quarter of 2009. <br />Diversion Channel <br />A diversion channel designed to intercept runoff north of the mine facilities, and <br />discharge into watersheds adjacent to the property has been constructed. The <br />diversion channel is approximately 2400 feet long and runs from elevation <br />7,418 to 7,375. The channel crosses public lands at the SE' /4SE'/NW %, <br />Section 24, Township 13 South, Range 92 West, 6th P.M. (see Map No.'s 8 -1, <br />8A -5, and 8A -7A thru C), along the northwest edge of the mine facilities area. <br />The channel meets the requirements of 4.05.3, 4.05.7, and 4.05.17. <br />The channel is constructed with tapered sides (V- shaped) using conventional <br />earth - moving equipment and techniques. Plans and specifications are as <br />contained in the Diversions Appendix in Volume 8A. The channel was <br />constructed from September, 1978, to June, 1979. <br />This contour channel was constructed to provide flood protection and to <br />minimize problems from water continually passing over and through the mine <br />site. The flood protection is necessary to promote stability of fill areas and <br />minimize material damage and perhaps, loss of life. For that reason, the <br />channel is designed for the probable maximum thunderstorm (PMTS). (Ref. <br />Leaf, Flood Hydrology Design Calculation, Surface Hydrology Appendix.)
