<br />SUMMIT COUNTY LAND USE AND DEVELOPMENT CODE <br />CHAPTER 10: Areas and Activities of State Interest <br />10000: INTRODUCTORY AND GENERAL PROVISIONS <br />A. Purpose and Intent <br />The purpose of this chapter is to enact Regulations governing Areas and Activities of State Interest pursuant to <br />C.R.S. § 24-65.1-101 et seq. as a means of ensuring that growth and development in Summit County are consistent <br />with legitimate environmental concerns and occur in a safe, efficient and coordinated manner and, further, ensuring <br />that adequate community services and facilities are provided in a manner consistent with the constitutional rights of <br />property owners, community goals and protection of the public welfare. <br />B. Authority <br />These Regulations are authorized by, inter alia, C.R.S. §§ 24-65.1-101 et seq., 30-28-101 et seq., 30-28-201 et seq., <br />29-20-101 et seq., and 24-32-111. <br />C. Definitions <br />The words and terms used in these Regulations governing Areas and Activities of State Interest shall have the <br />meanings set forth below. Where there is a conflict between these definitions and the definitions contained in <br />Chapter 15 of this Code, these definitions shall control for purposes of this Chapter 10. <br />Adverse: Unfavorable, harmful. <br />Affected Party: Any person with an interest in the outcome of the permit decision for the Proposed Project. <br />• <br />Agricultural Lands: Any land used primarily for the production of crops or livestock, including irrigated <br />meadows, irrigated and dry pasture, irrigation ditches, stock drive routes, lands used for barns, corrals and storage of is <br />crops or agricultural products, but not including lands used primarily for the production of commercial timber. <br />Applicant: A person submitting an application for a permit to engage in a development in a designated Area of <br />State Interest or to conduct a designated Activity of State Interest, who is either the owner of the property to be <br />developed, has written permission from the property owner for submittal of the project proposal or has authority to <br />condemn the property. <br />Aquifer Recharge Area: Any area where surface water may infiltrate to a water-bearing stratum of permeable <br />rock, sand or gravel. This definition will also include areas around wells used for disposal of wastewater or toxic <br />pollutants. <br />Area Around a Rapid or Mass Transit Facility: An area immediately surrounding and directly affected by a <br />rapid or mass transit facility as defined herein. <br />Arterial Highway: Any limited access highway that is part of the federal-aid interstate system or any limited- <br />access highway constructed under the supervision of the Colorado Department of Transportation ("CDOT"). <br />BOCC: The Summit County Board of County Commissioners. <br />Building: Any structure having a roof supported by columns or walls and intended for supporting or sheltering any <br />use or occupancy. <br />Building Permit: A permit which is issued by the Building Department prior to the erection, construction, <br />alteration, moving, relocation or change of use of any building or structure. <br />Code: Summit County Land Use and Development Code. <br />Collection System: A network of pipes and conduits through which sewage flows to a sewage treatment plant. . <br />4
