• Operations where basins remain under or pending extraction have been satisfied <br />by the approval letter of 13 December 2010; which include the Durham, Kurtz, <br />recently approved Heintzelman, and recently submitted Western Sugar permits. <br />• The activities at the Carr permit do not expose groundwater. <br />• The Seahorse Pond permit in Gunnison has a Decreed Substitute Supply Plan as <br />signed on 21 May 1997. <br />• Finally, the Seahorse West permit is undergoing transfer of permit. The land has <br />changed hands, but a Succession of Permit has yet to be submitted. Regardless, <br />a Substitute Supply Plan is in the hands of the State Engineer and presently <br />under review. Their preliminary review indicated approval is likely, and is <br />accepting affidavits to satisfy Approach #4 of the OMLR correspondence of 30 <br />April 2010, as referenced in the 31 December 2010 correspondence of Cheryl <br />Signs Engineering. <br />Copies of correspondence with the State Engineer, decree's, or related correspondence <br />referenced in the column under State Engineer Status are included as an attachment <br />with this submittal.
