;;

New Elk Mine TR-56
March 29, 2011
Page 3
constructing the well (versus constructing the well under an MH Notice) to maximize the
long-term use of the well. Monitoring wells must be constructed by an authorized individual
as defined in the WWCR. Construction by a licensed water well contractor is required of the
well will be converted to a production well at a later date.
3) Dewatering Well Permit: A permit to conduct dewatering operations. All dewatering
operations require a dewatering well permit. The scope of a dewatering well is limited to
dewatering only; use of the water beyond dewatering is not allowed under this permit. A
well constructed under an MH Notice can be converted to a dewatering well. If you plan on
using the water acquired from dewatering operations after the initial dewatering (this
includes uses such as dust suppression, potable water supply, operational uses) a non-
exempt permit must be obtained and the well will be considered a production well. A well
drilled under an MH Notice will not be eligible for conversion to any uses beyond the
immediate dewatering of the well. Dewatering wells must be constructed by an authorized
individual as defined in the WWCR. Note that short term dewatering for construction
purposes may be allowed under a Notice of Intent to Construct Dewatering Wells.
4) Production Well (exempt): These permits are assumed to be non-injurious to the stream
system so their use does not require augmentation water. However, their uses are also very
limited. These wells can be permitted either for drinking and sanitary purposes inside a
commercial business (up to 0.33 of/yr) or up to 3 single family dwellings, 1 acre of lawn and
garden irrigation, and the watering of the user's non-commercial domestic animals. They
are permitted as the only exempt production well on a qualified parcel. Wells drilled under
MH Notices cannot be permitted for these uses. Production wells must be constructed by a
driller licensed through the BOE.
5) Production Well (non-exempt): These wells may be presumed to be injurious to the stream
system; in general, if the operation is in an overappropriated stream system a decreed
augmentation plan or Substitute Water Supply Plan approved by the SEO will be required to
operate under this type of permit. These well permits cover most other water uses. This
includes water used for site operations, irrigation or outdoor uses, and dewatering with
supplemental beneficial uses. Also, any ponds or operation pits that intercept ground water
are considered wells; they will require non-exempt permits. Multiple non-exempt wells can
exist on a parcel. Wells drilled under MH Notices cannot be permitted for these uses.
Production wells must be constructed by a driller licensed through the BOE.
The previous list is a general summary only, it is not intended to be all inclusive nor does it list all of the
requirements and limitations of the permit types mentioned. There is no guarantee that any permit will
be issued until an application is submitted to the SEO and the application evaluation is completed. More
information on these permit types, and the specific requirements and limitations associated with each,
is available on the DWR website at http://water.state.co.us, or may be available by calling the Ground
Water Information Desk at (303) 866-3587.
Thank you for the opportunity to comment on this application. If you have any further questions
regarding this matter, please feel free to contact me directly at this office or contact the local Water
Commissioner. The Water Commissioner for District 19 is Jeff Montoya, who may be contacted at (719)
680-1052 or via email at Jeff. Montoya@state.co.us.
