Connell Resources Timnath Pit <br />Spill Prevention Control and Countermeasures Plan <br />Revision Date: June 25, 2009 <br />Section 1.0 Introduction <br />Page 1-1 <br />Section 1.0 Introduction <br />1.1 Purpose [112.1(a)(1)] <br />The purpose of the Environmental Protection Agency's (EPA's) Spill Prevention Control and <br />Countermeasures (SPCC) regulation is to prevent oil spills from impacting waterways. This <br />SPCC Plan was prepared to document the Connell Resources Timnath Pit Facility's <br />(Facility) compliance with the SPCC regulation. <br />1.2 Applicability [112.1(b)] <br />The Facility is subject to the SPCC regulation because the Facility: <br />• Has a reasonable expectation of having a spill that could impact waters and natural <br />resources of the United States (i.e., Nearby Waterway), <br />• Is subject to the EPA's jurisdication (i.e., the facility is not solely transportation <br />related and is not an offshore oil rig), and <br />• Has over 1,320 gallons of above ground storage (i.e., 48,000 gallons). <br />1.3 Definitions [112.2] <br />The following definitions from the SPCC Regulation [40 CFR 112.2] are included to assist <br />Connell in understanding the SPCC regulation. The inclusion of a definition does not imply <br />regulatory issues related to the Facility. <br />1.3.1 Bulk Storage Container <br />Bulk storage container means any container used to store oil. These containers are used <br />for purposes including, but not limited to, the storage of oil prior to use, while being used, or <br />prior to further distribution in commerce. Oil-filled electrical, operating, or manufacturing <br />equipment is not a bulk storage container. <br />1.3.2 Completely Buried Tank <br />Completely buried tank means any container completely below grade and covered with <br />earth, sand, gravel, asphalt, or other material. Containers in vaults, bunkered tanks, or <br />partially buried tanks are considered aboveground storage containers for purposes of this <br />part. <br />1.3.3 Discharge <br />Discharge includes, but is not limited to, any spilling, leaking, pumping, pouring, emitting, <br />emptying, or dumping of oil, but excludes discharges in compliance with a permit under <br />section 402 of the CWA; discharges resulting from circumstances identified, reviewed, and
