Pineda <br />Director <br />The Division of Reclamation, Mining, and Safety (Division) has completed Preliminary Adequacy Review <br />for the above referenced application. The public comment period has closed and none were received. <br />A few issues need to be clarified or corrected. Please address the following: <br />In the mining plan 6.4.4: <br />1) (b) Notes that topsoil will be stockpiled in a designated area and sedimentation control put in <br />place. Please address how the applicant will address Rule 3.1.9(1) to protect the topsoil <br />stockpile from wind and precipitation erosion. <br />2) (c) and Map C-2 note sedimentation structures. Due to the length of proposed mining activities <br />staff questions whether more durable materials should be used other than logs and hay bales <br />for sedimentation structures. Since the mine is for rip-rap materials it is suggested that the <br />applicant use some available material in construction to prevent future degradation or <br />maintenance issues. Please clarify why the materials noted should be used. <br />3) (i) notes no structures within several hundred yards. A Division pre-operational inspection <br />confirms this. However several homes and structures were noted to the south / southeast. <br />Please clarify the anticipated frequency of blasting and clearly note the distance and topography <br />to the closest structure to the south. <br />In the Reclamation Plan 6.4.5: <br />1) Per (2)(e) the plan notes that the applicant will need to import approximately 28,000 cubic yards <br />of native backfill to achieve 3:1 required slopes. Staff normally requires the identification of a <br />source for such materials and bonds for its delivery. While a local authority is not required to <br />post a bond, the question of a source for such materials is still valid. It I understood that it may <br />be some time before actual subsurface excavation begins in earnest and the need for such <br />backfill material is required. Please have the applicant identify a benchmark in mining were they <br />will be required to notify the Division of a source of materials to meet this reclamation <br />requirement. <br />2) Associated with the importation please address the requirements of Rule 3.1.5(9) for the <br />importation of inert fill. <br />Office of <br />Office of <br />Mined Land Reclamation Denver • Grand Junction ,• Durango Active and Inactive Mines
