Response #1 is in reference to a Condition of Approval contained in this agency's Response <br />to Reclamation Permit Conversion Application Consideration submitted to the Division of Reclamation, <br />Mining and Safety on February 7, 2011, which is restated under Requirement #1 in your letter. This <br />Condition of Approval relates to the containment of stormwater, and requires that any stormwater <br />contained on-site must infiltrate into the ground or be released into the natural stream within 72 hours, <br />or all work must cease until a substitute water supply plan, or augmentation plan approved by water <br />court, is obtained. <br />Your response references case no. 06CW91, which contains a surface water right, storage rights, and a <br />plan for augmentation as decreed by the Division 7 Water Court. The storage rights decreed for Wildcat <br />Augmentation Pond #1, Wildcat Augmentation Pond #2, and Idaho Mill Settling Pond identify the source <br />of storage water as, "Surface water draining out of Idaho Mine Portal into unnamed channel tributary to <br />the La Plata River, diverted through the IMD". Furthermore, the augmentation plan decreed in this case <br />specifically identifies the out-of-priority diversions augmented to be those at the Idaho Mill Diversion <br />(IMD).
