Permit No. C-1983-059 Pf is i•. y J <br />Response to February 23, 2011 Midterm Permit Review <br />Dear Mr. Dudash: <br />The following information is submitted to the Division on behalf of Terror Creek LLC, in order <br />to respond to the cited Midterm Review. In particular, we are responding to the six (6) <br />Adequacy Review comments presented on page 4 of the Review. We have also included draft <br />revised pages for discussion purposes. Assuming the Division concurs with our proposed <br />modifications, we will follow-up with a minor revision to facilitate inclusion of the pages into <br />the PAP. <br />Item 1- Identification of Interests - We have reviewed the ownership information found on the <br />appropriate PAP pages and found modifications are necessary. To facilitate these changes, please <br />see the attached pages 2.03-5, 6, 7 and 8. We have also reviewed the surface ownership <br />information and found the change noted on the attached page 2.03-9. A modified Map 1, Surface <br />Ownership will also be prepared for the Minor Revision. <br />Item 2 - Section 2.03.5 - Compliance Information - We have found that this section will not <br />require an update. <br />Item 3 - Use of Shop Facility - Please see the attached modified page 2.05-2b for a description <br />of the relationship between lessees of the shop facility and TCLLC. The important point to make <br />is that TCLLC retains both the control of the facility and the reclamation liability. <br />Item 4 - Storage Tank Inventory - The attached modified page 2.05-2c provides an update of the <br />inventory of storage tanks. Diesel Tank #1 was taken out of service, moved and is now used to <br />store additional water for dust control. The diesel storage is now provided by Tanks #9 and #10. <br />The Tank #5, 10,000 gallon, double walled diesel storage tank is now owned by the private <br />trucking company lessee of the shop facility. <br />0 Page 1
