This amendment will designate <br />the additional acreage as a stock pile area. <br />® The proposed operation will continue to consume ground water by: ® evaporation, ® dust <br />control, ®reclamation, ® water removed in the mined product, ® processing, ® other: <br />dewatering. <br />Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel <br />pit or other type of well permit, as applicable. However, prior to obtaining a permit, an approved <br />substitute water supply plan ("SWSP") or decreed plan for augmentation is required. According <br />to the State Engineer's Office records an SWSP was submitted on November 8, 2010 and this <br />SWSP is pending evaluation. According to the information from the SWSP, a slurry wall has <br />been constructed around the perimeter of the mine; however, tests have indicated that there is <br />a leak in the liner. The owner of the 124th Estates Pit is currently working to fix the slurry wall. It <br />is currently anticipated that the slurry wall liner will be fixed and approved by June 30, 2011. <br />Therefore, all lagged depletions must continue to be replaced under a substitute water supply <br />plan ("SWSP") until there is no longer an effect on stream flow. <br />COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in <br />priority, it must be released to the stream system within 72 hours. This may require a discharge permit <br />from CDPHE-WQCD.
