(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1980-110 <br />INSPECTION DATE: 02 March 2011 INSPECTOR'S INITIALS: DB2 <br />OBSERVATIONS <br />This inspection was conducted by David Bird of DRMS along with Matt Alexander representing the operator. <br />The site is located about four miles south-southwest of Brighton and about one mile northeast of the town of <br />Henderson, just west of the intersection of E-470 and Highway 85. Mining is complete and the site is in <br />reclamation. Sand and gravel were the commodities produced at the site. The DRMS permit system shows <br />the permit acreage at 42.8, affected acreage at 42.0, disturbed acreage at 33.0, maximum allowed acreage at <br />75.8 and private acreage at 76.0. The Division holds no financial warranty as the operator is a government <br />entity. The post-mining land use is described as residential. <br />The reclaimed water storage reservoir appears stable with properly constructed shorelines, and appears to <br />have well-established vegetation with limited weed growth. However, several problems were noted that <br />require operator attention. <br />1) Signs and Markers. The sign required by Rule 3.1.12(1) is missing. The problem and corrective action are <br />described in further detail on page 3 of this report. <br />2) Reclamation Plan. The reclamation performed to date does not appear to be in strict conformance with that <br />described in the approved Reclamation Plan. Probably the most noteworthy example is the unlined reservoir, <br />whereas the Reclamation Plan specifies a lined reservoir. At some time in the future and before release can <br />be granted, the operator must file a Technical Revision JR) to make the Reclamation Plan consistent with the <br />reclamation that has been performed on the ground. In the TR, the operator should revise the reservoir plan, <br />and perhaps the post-mining land use which currently is specified as residential. Further discussion is <br />provided on page 3 of this report. <br />3) Hydrologic balance. The existence of an unlined reservoir of this size creates significant evaporative loss. <br />The regulatory implications of this along with compliance requirements and timeline were described in a letter <br />sent by DRMS to operators in April of 2010. A copy of the letter is attached for your reference. Operators <br />have until April 30, 2011 to demonstrate movement toward compliance.
