MAR 16 2011 <br />GRAND J VTION FIELD OFF <br />OLAMA]70N MINI a WEly <br />Re: Lost Cause Pond, Permit/File No. M-2010-084, Phone Conversation <br />Dear Mr. Czapla: <br />In relation to our phone call yesterday, March 15, 2011, in relation to the Lost Cause 110 <br />application, please find the following responses as a re-address of the following issues we discussed. <br />In regard to the concerns presented by the Division of Water Resources in relation to: <br />• The applicant has indicated plans to use other water for: <br />o Other: The applicant states intent to bring water for dust control. Any water <br />brought on site must be from a legally available water supply. The pond must be <br />able to make releases from a low level outlet in the instance of a call on the <br />stream system. <br />¦ At this time, Lost Cause LLC does not intend to bring in any water for <br />dust control and will not be required by Mr. Czapla per our phone <br />conversation on March 15, 2011. ' <br />¦ Through investigation / speaking with Erin Light, Division Engineer, <br />Water Division 6 of the Colorado Division of Water Resources, Lost <br />Cause LLC will install a low level outlet or a means of bypassing the <br />inflow of water, when and if, it is required due to Subject To <br />Administration. According to my phone conversation with Erin Light, <br />this is only required if the water becomes ON CALL / Subject To <br />Administration. Therefore, Lost Cause LLC is acknowledging this <br />cE`v ' requirement and due hereby attest to the fact that if the water flowing <br />into the Lost Cause Pond becomes ON CALL / Subject To <br />Administration, the owners will install a low level outlet or provide a <br />??sUp?? means of bypassing the inflow of water into the stock water pond as <br />Viviskolp of ge necessary to meet the Colorado Division of Water Resources <br />WIN &540W requirements.
