Jared Dains Page 13 <br />South Platte Combined Replacement Plan <br />March 21, 2011 <br />5. The applicant may only utilize the 19.6 shares in the Leggett-Owens Ditch and Reservoir in <br />this plan if all required measurement and bypass structures have been installed and <br />approved by the water commissioner. <br />6. The applicant may only utilize the 240 shares of the Boyd & Freeman Ditch in this plan if <br />accurate measuring and recording devices are installed by April 2011 and those devices are <br />approved by George Varra, the District 3 Water Commissioner. <br />7. The total area of pond surface exposed for each of the pits shall not exceed those values <br />listed in Table 1 of this approval. Should the total surface area exposed exceed those <br />amounts, an amendment will need to be filed with this office. The total amount of ground <br />water to be consumed at the gravel mining operations shall not exceed the values listed in <br />Table 4 of this approval. Should the amount of ground water to be appropriated from each <br />of the pits exceed the values listed in Table 4, an amendment will need to be filed with this <br />office. <br />8. For purposes of this SWSP, if the distance from the surface of the exposed ground <br />water area to the river was measured based on the down gradient extent of the <br />exposed ground water surface (nearest point), this method used to measure the <br />distance to estimate the lagged depletions will be accepted, however any future <br />SWSP must measure the distance from1he exposed ground water surface area to the <br />river based on the centroid of the exposed ground water surface. <br />9. The applicant is seeking to claim credit for water returned to the stream system from <br />dewatering in excess of the depletions caused by dewatering. Prior to claiming any credit <br />for the water returned to the stream system from dewatering the applicant must install an <br />adequate measuring device to measure the quantity of water being pumped for dewatering <br />purposes. <br />10. The installation of any device used for measuring replacement water in this plan must be <br />inspected by a Division 1 hydrographer. Furthermore, the exact location of all return <br />structures utilized in this plan must be provided to the Division Engineer and Water <br />Commissioner in order to allow for inspections of the structures. Finally, all charts or other <br />output data associated with each measuring device utilized in this plan must be provided in <br />a timely manner acceptable to the Water Commissioner. <br />11. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. In addition, the applicant shall maintain daily records <br />of all diversions, replacements, and the amount of water used for each particular purpose. <br />The applicant shall provide a report of these records to the division engineer and the water <br />commissioner on a monthly basis on a form approved by them. The accounting must be <br />submitted to the division engineer in Greeley (Div1 Accounting estate. co. us) and the water <br />commissioners Scott Edgar (Scott. EdgarOstate.co.us), George Varra <br />(George Varra.Cilstate.co.us), Shera Sumerford (Shera.SumerfordO-state.co.us), and Bob <br />Carlson (Bob. CarisonO-state.co.us) within 30 calendar days of the end of the month for <br />which the accounting is being made. All amounts shall be in acre-feet. <br />In addition, the applicant shall submit a report from each entity making replacements; for <br />this plan, those entities are the City of Westminster, City of Thornton, City of Greeley, Platte <br />j
