Dedication of Water Rights to the <br />Aggregate Industries Combined Substitute Supply Plan <br />Aggregate Industries - WCR, Inc. (AI), is the owner of 12.5 shares of the Whitney Ditch <br />Company (which are associated with the W.W. Farms Pit, DRMS Permit No. M-99-098), and 96 <br />shares of the Fulton Irrigating Ditch Company (which are not associated with any specific site <br />but rather are associated generally with the entire Al Combined Substitute Water Supply Plan <br />(CoSSP). Al hereby affirms that the above water rights will be dedicated solely to the Al CoSSP <br />for as long as there are depletions at the associated gravel pits or until such time as another <br />replacement source is obtained.
