i March 9, 2011 RECEIVED <br />Division Of Reclamation, Mining and Safety <br />c/o DRMS Grand Junction Field Office MAR r R <br />101 South 3rd Street t", 1 zo - 1 i <br />Grand Junction, CO 81501 Division of Reclamation, <br />UnIng $ Safe <br />REcevEp <br />MAR 14 2011 <br />GRAND JUNCTION FIELD OFF <br />WCLAM,gTf08OV OF <br />MINMG 8, SAFM <br />Re: Lost Cause Pond, Permit/File No. M-2010-084, Comments from Division of Water <br />Resources regarding 110c application <br />Mr. Czapla: <br />Please find the following response in relation to the letter you received from the Division of Water <br />Resources and the concerns that need to be addressed in regard to Conditions For Approval. <br />The proposed operation will consume ground water by. <br />o Evaporation <br />¦ Yes, evaporation will naturally occur from any water that may be captured within <br />the stock pond that has existed since its construction prior to Mr. Mantle's <br />ownership of the property. <br />o Other: It is unclear whether this pond exposes ground water. If the pond does expose <br />ground water the pond will require a well permit from the State Engineer's Office (SEO) <br />or an impermeable lining to prevent the exposure of ground water. <br />¦ The stock water pond does not expose ground water and should be <br />acknowledged that Eureka Creek drainage is a dry drainage. Only when there is <br />unusually sudden thawing of snow or an occasional cloudburst during the <br />summer (which is why there is silt/sediment captured in the stock water pond) <br />does the drainage contain any water. As notated in the site description, this is <br />high desert rangeland terrain which is represented by the dry vegetation that is <br />natural to the environment. As addressed in the application of Need For State <br />Reclamation Permit -M-2010- Question 11. Will the site of extraction result in <br />the exposure of tributary ground water ... .... As originally filed, "No." In <br />addition, it was notated in the application 6.3.3(1). There will be no groundwater <br />encountered which remains the same. <br />The applicant has indicated plans to use other water for: <br />o Uses at the permit site <br />¦ The only uses at the permit site notated in regard to "other water" was referenced <br />in 6.3.3(h) which stated..., any water is to be used, it will be used for dust <br />control purposes. <br />o Storage in the excavated area(s) <br />¦ Other water was not notated or referenced in relation to the excavated area(s) <br />outside of dust control purposes. <br />o Other: The applicant states intent to bring water for dust control. Any water brought on <br />site must be from a legally available water supply. The pond must be able to make <br />releases from a low level outlet in the instance of a call on the stream system. <br />¦ If, any water is to be used for dust control purposes it will be attained from Mr. <br />Mantle who possesses water rights from Piceance Creek as notated in 6.33(h), in
