Lost Cause Pond, File No. M-2010-084, Response to Division of Water Resources comments <br />Dear Mrs. Tabor: <br />Thank you for your response to the comments submitted by the Division of Water Resources (DWR) on <br />March 3, 2011. In your response you have clarified that the stock water pond does not expose <br />groundwater. Please note that exposure of groundwater at this site must not occur during or after the <br />mining operations. <br />The application states that it is anticipated that water will be used for dust control during this operation. <br />The comments provided by DWR state that water brought on site must be from a legal source. Please <br />submit documentation to this office showing that Mr. Mantle's water rights for the Piceance Creek allow <br />for industrial uses. <br />The DWR comments also state that water stored in the stock water pond must be releasable through a <br />low level outlet.
