RE. Lost Cause Pond, File No. M-2010-084, Response to Division of Water Resources comments
Dear Mrs. Tabor:
Thank you for your response to the comments submitted by the Division of Water Resources (DWR) on
March 3, 2011. In your response you have clarified that the stock water pond does not expose
groundwater. Please note that exposure of groundwater at this site must not occur during or after the
mining operations.
The application states that it is anticipated that water will be used for dust control during this operation.
The comments provided by DWR state that water brought on site must be from a legal source. Please
submit documentation to this office showing that Mr. Mantle's water rights for the Piceance Creek allow
for industrial uses.
The DWR comments also state that water stored in the stock water pond must be releasable through a
low level outlet. Please provide details to this office of the type structure to be used.
