M-1990-134.
The Ross Pit operates under well permit no. 74946-F. The permit was issued on March 22,
2011 for the operation of a well (gravel pit) exposing and diverting ground water tributary to the
Yampa River at a point where unappropiriated water is available for withdrawal. The uses of
permit no. 74946-F are limited to: "during mining operations the use of ground water, in
addition to dewatering (at 1000 gpm), is limited to evaporation (55.20 AF/yr), losses by
removal of aggregate product (0.07 AF/yr) and dust control (4 AF/yr). Upon completion of
mining operations the use of ground water is limited to evaporation (55.20 AF/yr) and
recreational purposes including fish propagation and wildlife habitat. No other use of this
water is allowed unless a permit therefor is approved." The total surface area of the proposed
ground water pond limited to 23 acres. A cross section drawing showing the extent of the
excavation, maximum depth, static water level and the date the ground water was exposed
was submitted to the SEO on January 10, 2011 indicating that the pit was excavated in July
1990. This permit is valid per § 37-90-137(2) and (11), C.R.S.
Per a conversation with Bud Bower on January 6, 2011, portions of the area in the acreage
release request are submerged as was proposed in the mine reclamation plan and as
permitted under 74946-F for recreational purposes upon completion of gravel mining
operations. This office has no objections to the release of this area so long as the site
continues to operate under a valid permit.
The applicant may contact the State Engineer's Office with any questions.
4-
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589
http://water.state.co.us
